Independence Australia is committed to the protection of your privacy and follows the National Privacy Principles as outlined in the Privacy Amendment Act 2000, we recognise each person’s right to privacy and confidentiality.

  • Only relevant personal information will be collected with prior consent
  • Requests for personal information can be made by contacting our HR Manager
  • Personal information will not be disclosed without prior consent from the individual
  • Independence Australia's web-site can be viewed without disclosing personal information
  • Any personal information provided through our web-page forms is protected by this Privacy Policy
  • All confidential information will be archived or disposed of securely.

ACCESS TO PERSONAL INFORMATION GUIDE

Under the Commonwealth & Victorian Privacy Legislation and Independence Australia's Privacy Policy people have the right to be provided with access to information held by Independence Australia unless the information is exempt from release. In particular, people have a right of access to their personal information and they may have the records amended if the information about them is not accurate, complete or up-to-date.

What information can be requested?

Personal information can be sought - and it may be in the form of written records, stored on computer, photographs and the like.

How can I make a request?

Your request must be in writing and contain sufficient details to enable Independence Australia to identify the information required. Your request should be signed and dated and give a postal address and a contact telephone number if possible. You should also state whether you simply wish to inspect the documents or wish to have a copy supplied to you.

Provision of Information

If a person is granted access to the information they may:

  • Inspect the records;
  • Receive a photocopy or transcript;
  • View or hear the information.

Fees and Charges

The legislation and regulations provide for fees to be charged for providing access to personal information to be paid by an applicant. In summary these charges are:

  • $25.00 plus
  • 20c for each page for non-coloured A4 pages of photocopy
  • Other reasonable costs
  • The maximum charge for personal information is $100
  • Charges may be reduced or waived altogether at the discretion of Independence Australia.
    e.g.: If the enquirer can show that they have very limited financial means, there will be no charge.
    If Independence Australia considers that the request is routine there may be no charge.

Decisions

The enquirer will be notified of the decision about their request as soon as practicable and within 30 days of Independence Australia receiving their request. If the enquirer's request is partially or fully refused, they will be sent a notice giving reasons for the decision and advising them of their review rights.

Amending Personal Information

If the enquirer believes that the personal information held by Independence Australia is not accurate, complete or up-to-date they may request amendment of the information. There are no charges for amending personal information.

A request to amend information must:

  • be in writing
  • give an address for notice
  • give details of the information which they believe is not accurate, complete or up-to-date
  • specify the amendments they want made

The enquirer should also supply evidence to back up their request. Independence Australia can amend their information by altering the information or by adding a notation.

Notation of Claims

Even if the amendment is refused, a person can request Independence Australia to add a notation to the information setting out their claims as to why they believe the information is incorrect, incomplete, and out of date or misleading.

You may complain to the Privacy Officer privacy@independenceaustralia.com if you have been affected as a result of the rules of the Act being breached. The Office of the Federal Privacy Commissioner has produced a complaint form. The Privacy Commissioner's hotline service is 1300 363 992.

Changes to this Statement

This information is summary only and based on the requirement of the privacy Act (Private Sector) 1988 and the National Privacy Principles issued September 2001. It will be reviewed annually and updated as required by the relevant Act.
